Welcome to Sailbaba.com (“Sailbaba,” “we,” “us,” or “our”).
Sailbaba operates an online marketplace and digital listing platform dedicated to luxury yachts, boats, ships, cruise vessels, and other high-value marine vessels. Sailbaba provides a platform through which yacht owners, manufacturers, brokers, dealers, sellers, and authorized representatives may purchase listing space and showcase eligible vessels to prospective buyers and other visitors.
These Terms & Conditions (“Terms”) govern your access to and use of Sailbaba.com, including the purchase and use of yacht listing services.
By accessing, browsing, registering on, purchasing listing space through, submitting content to, or otherwise using Sailbaba.com, you agree to be legally bound by these Terms.
If you do not agree with these Terms, you should not use the website or purchase any listing service.
1. DEFINITIONS
For the purposes of these Terms:
“Sailbaba”
Means Sailbaba.com and the business/entity operating the website and its related services.
“Website”
Means Sailbaba.com and any associated pages, features, systems, or digital services operated by Sailbaba.
“Listing”
Means a yacht or other eligible vessel displayed on the Website.
“Listing Customer”
Means any person, company, yacht owner, manufacturer, broker, dealer, representative, agent, or other entity that purchases listing space or submits a yacht for listing on Sailbaba.
“Seller”
Means the yacht owner or any person or entity offering, advertising, representing, or authorized to offer a yacht for sale.
“Buyer”
Means any individual, company, organization, or other entity that visits the Website or communicates with a Listing Customer for the purpose of potentially purchasing or learning about a yacht.
“Listing Space”
Means the digital space, placement, package, or other listing service purchased by a Listing Customer for displaying information about a yacht on Sailbaba.
“Yacht”
Means a yacht, boat, ship, cruise vessel, superyacht, megayacht, or other marine vessel eligible for listing on Sailbaba.
“Listing Content”
Means photographs, videos, descriptions, specifications, technical information, pricing, documents, trademarks, logos, and other materials submitted by a Listing Customer in connection with a Listing.
2. ACCEPTANCE OF THESE TERMS
These Terms apply to all visitors, Buyers, Listing Customers, Sellers, brokers, manufacturers, representatives, and other persons who access or use Sailbaba.
Additional terms may apply to particular services, promotions, listing packages, or features offered by Sailbaba.
If there is a conflict between these Terms and specific terms expressly provided for a particular service, the specific service terms shall apply to the extent of that conflict.
3. NATURE OF SAILBABA’S PLATFORM
Sailbaba is an online yacht listing and marketplace platform.
Sailbaba’s primary role is to provide digital space and related services through which eligible yachts may be presented to potential buyers.
Unless expressly stated otherwise, Sailbaba:
- Does not own the yachts displayed on the Website;
- Does not sell yachts on behalf of Sellers;
- Is not the manufacturer of the yachts listed on the Website;
- Is not automatically acting as a broker, dealer, agent, fiduciary, or representative of any Seller;
- Does not take ownership or possession of listed yachts;
- Does not determine the final selling price of a yacht;
- Does not enter into the yacht sale agreement between Buyer and Seller;
- Does not receive ownership of a yacht as part of the listing process; and
- Does not guarantee that a yacht will be sold.
The purchase of Listing Space from Sailbaba is a purchase of listing and promotional services, and does not constitute the purchase of a yacht.
4. WHO MAY PURCHASE LISTING SPACE
Listing Space may be purchased or requested by:
- Yacht owners;
- Yacht manufacturers;
- Authorized dealers;
- Yacht brokers;
- Authorized representatives;
- Authorized agents;
- Companies or organizations legally entitled to represent a yacht; and
- Other persons or entities approved by Sailbaba.
A person submitting a yacht confirms that they have the legal right or appropriate authorization to advertise and represent that yacht.
If you are submitting a yacht on behalf of another person or entity, you represent that you have the authority to do so.
5. OWNERSHIP AND AUTHORIZATION VERIFICATION
To maintain the credibility and quality of the Sailbaba marketplace, Sailbaba may request information or documentation to verify:
- That the yacht exists;
- That the yacht information submitted is reasonably authentic;
- That the Listing Customer is the owner or is otherwise authorized to represent the yacht; and
- That the Listing Customer has the right to advertise the yacht on Sailbaba.
Such verification may include ownership documentation, registration information, company documentation, authorization letters, broker documentation, or other reasonable supporting information.
5.1 Purpose of Verification
The purpose of this process is to reduce fraudulent, misleading, unauthorized, or fictitious listings and to maintain the integrity of the platform.
5.2 Verification Does Not Constitute a Guarantee
Any verification performed by Sailbaba is a platform-level verification process only.
Verification does not constitute:
- A legal title search;
- A certification of ownership;
- A guarantee of clear title;
- A guarantee of the yacht’s condition;
- A guarantee of seaworthiness;
- A guarantee of the accuracy of every specification;
- A valuation or appraisal;
- A mechanical or technical inspection;
- A guarantee that the yacht is free from liens, claims, encumbrances, disputes, or other legal interests; or
- A guarantee that a transaction will be completed.
Buyers remain responsible for conducting their own independent legal, technical, financial, and other due diligence before entering into any transaction.
6. CONFIDENTIAL VERIFICATION INFORMATION
Information or documents provided specifically for ownership or authorization verification are treated separately from information intended for public display.
Sailbaba does not intend to publish private ownership, authorization, identity, registration, corporate, or verification documentation as part of a public yacht listing.
Such information will be used for verification and platform administration purposes and will not be publicly displayed merely because a yacht has been listed.
Sailbaba will not sell or rent such verification information to third parties for their independent marketing purposes.
Sailbaba may disclose information where reasonably necessary to comply with applicable law, valid legal process, governmental requirements, prevent fraud, protect the Website, or protect the rights and safety of Sailbaba and others.

7. SUBMISSION OF A YACHT LISTING
When submitting a yacht for listing, the Listing Customer must provide accurate, complete, and current information.
Depending on the Listing package, this may include:
- Yacht name;
- Manufacturer/builder;
- Model;
- Year of construction;
- Length;
- Beam;
- Draft;
- Gross tonnage;
- Engine and motor specifications;
- Engine manufacturer;
- Engine power;
- Speed;
- Range;
- Fuel capacity;
- Water capacity;
- Cabins and berths;
- Crew accommodation;
- Amenities;
- Technical specifications;
- Location;
- Asking price;
- Photographs;
- Videos;
- Yacht description; and
- Other relevant information.
Sailbaba may request clarification or supporting information before approving a Listing.
8. ACCURACY OF LISTING INFORMATION
The Listing Customer is solely responsible for ensuring that all Listing Content submitted to Sailbaba is accurate, lawful, current, and not misleading.
The Listing Customer must not:
- Provide false or materially misleading information;
- Misrepresent ownership;
- Misrepresent authorization;
- Use another person’s photographs without permission;
- Falsify yacht specifications;
- Misrepresent the yacht’s condition;
- Misrepresent the yacht’s location;
- Advertise a yacht that they are not authorized to represent;
- Manipulate pricing or specifications in a misleading manner; or
- Submit fraudulent, deceptive, or fictitious listings.
If information changes after publication, the Listing Customer should promptly request that the Listing be updated.
9. SAILBABA’S RIGHT TO REVIEW AND REJECT LISTINGS
Sailbaba reserves the right, at its sole discretion and without being required to provide a detailed explanation, to:
- Review submitted Listings;
- Request additional information;
- Request ownership or authorization documentation;
- Approve or reject a Listing;
- Modify the presentation or formatting of a Listing;
- Remove content that violates these Terms;
- Suspend a Listing;
- Remove a Listing;
- Restrict an account; or
- Refuse future Listing submissions.
Sailbaba may take such action where it reasonably believes that a Listing may be fraudulent, misleading, unauthorized, unlawful, inappropriate, inaccurate, or inconsistent with the standards or interests of the platform.
10. PURCHASE OF LISTING SPACE
Listing Space may be offered through the Website as a paid product or service.
The Listing Customer agrees to pay the applicable price displayed or otherwise communicated by Sailbaba for the selected Listing package.
Prices may vary depending on factors such as:
- Listing duration;
- Listing package;
- Placement;
- Featured status;
- Promotional services;
- Additional visibility;
- Number of Listings; or
- Other services selected by the Listing Customer.
Payment may be processed through third-party payment providers.
The Listing Customer agrees to provide accurate billing and payment information.
11. LISTING PERIOD
Unless otherwise stated at the time of purchase, a Listing will remain active for the period specified in the applicable Listing package.
A Listing may expire automatically at the end of the applicable period.
Renewal may be available where offered by Sailbaba.
Sailbaba does not guarantee that a Listing will receive a particular number of views, enquiries, leads, offers, or sales during its Listing period.
12. REFUNDS AND CANCELLATIONS
Unless otherwise stated in the applicable Listing package or required by applicable law, payments for Listing Space are generally non-refundable once the Listing service has been activated, published, or work has commenced on the Listing.
If Sailbaba rejects a Listing before the Listing service has commenced due to reasons attributable to Sailbaba’s eligibility requirements, Sailbaba may, at its discretion, offer a refund or alternative resolution.
No refund is guaranteed where:
- The Listing Customer provided false or misleading information;
- The Listing Customer lacked authority to list the yacht;
- The Listing violated these Terms;
- The Listing was removed due to misconduct or breach;
- The Listing Customer requested removal after publication; or
- The yacht was sold, withdrawn, or otherwise became unavailable after publication.
Any specific refund terms displayed at the time of purchase will take precedence where applicable.
13. LISTING CONTENT AND INTELLECTUAL PROPERTY
The Listing Customer retains ownership of intellectual property rights in Listing Content that it lawfully owns or controls.
By submitting Listing Content to Sailbaba, the Listing Customer grants Sailbaba a non-exclusive, worldwide, royalty-free license to use, reproduce, display, publish, distribute, format, modify for presentation purposes, and promote that Listing Content for the purpose of:
- Displaying the Listing;
- Operating the Website;
- Marketing the Listing;
- Promoting Sailbaba;
- Improving the platform; and
- Providing the services purchased by the Listing Customer.
The Listing Customer represents that it has all necessary rights and permissions to provide such content to Sailbaba.
14. PHOTOGRAPHS, VIDEOS AND OTHER MEDIA
The Listing Customer must ensure that it has permission to use and publish all photographs, videos, logos, trademarks, drawings, specifications, and other media submitted to Sailbaba.
The Listing Customer agrees not to upload content that infringes another person’s copyright, trademark, privacy, publicity, or other legal rights.
Sailbaba may remove media where it receives a credible complaint or reasonably believes that the content may infringe third-party rights.
15. BUYERS AND WEBSITE VISITORS
Visitors may browse yacht Listings without purchasing Listing Space.
A Buyer may contact a Listing Customer using the communication methods provided by Sailbaba.
Information displayed in Listings is generally provided by the Listing Customer.
Buyers should independently verify all material information before entering into a transaction.
16. BUYER DUE DILIGENCE
Buyers are solely responsible for conducting appropriate due diligence before purchasing or entering into any agreement relating to a yacht.
Such due diligence may include:
- Verification of ownership and title;
- Verification of registration;
- Verification of liens and encumbrances;
- Independent yacht inspection;
- Mechanical inspection;
- Survey;
- Sea trial;
- Review of maintenance records;
- Review of classification records;
- Verification of engine and equipment information;
- Legal review;
- Financial due diligence;
- Verification of taxes and duties;
- Insurance requirements;
- Import/export requirements; and
- Any other investigation appropriate to the transaction.
Sailbaba strongly recommends that Buyers obtain independent professional advice before completing a transaction.
17. YACHT TRANSACTIONS
Unless expressly agreed otherwise in writing, Sailbaba is not a party to any transaction between a Buyer and Seller.
Any negotiation, offer, purchase agreement, deposit, payment, inspection, survey, sea trial, financing, insurance, delivery, transportation, registration, title transfer, tax payment, or other transaction relating to a yacht is solely between the relevant parties.
Sailbaba does not control and is not responsible for the completion, cancellation, performance, or legality of any transaction between Buyers and Sellers.
18. NO GUARANTEE OF YACHT INFORMATION
Sailbaba makes reasonable efforts to maintain the quality and integrity of its marketplace; however, Sailbaba does not guarantee that every Listing is:
- Completely accurate;
- Current;
- Complete;
- Error-free;
- Available;
- Correctly valued;
- Free from liens or claims;
- In the condition represented;
- Seaworthy;
- Legally transferable; or
- Suitable for a particular Buyer.
Any specifications, photographs, descriptions, pricing, performance information, or other Listing Content should be independently verified by the Buyer.
19. NO GUARANTEE OF SALE OR LEADS
Sailbaba does not guarantee that purchasing Listing Space will result in:
- Enquiries;
- Offers;
- Leads;
- Meetings;
- Negotiations;
- A sale;
- A particular sale price; or
- Any financial return.
The effectiveness of a Listing may depend on factors outside Sailbaba’s control, including market conditions, yacht pricing, location, demand, presentation, specifications, and Buyer interest.
20. PROHIBITED USES
Users must not use Sailbaba to:
- Commit fraud;
- Misrepresent ownership or authorization;
- Submit fictitious Listings;
- Impersonate another person or company;
- Upload stolen or unauthorized content;
- Mislead Buyers;
- Manipulate Listings or Website functionality;
- Attempt unauthorized access to Sailbaba systems;
- Introduce malware or malicious code;
- Scrape or systematically extract Website data without authorization;
- Use Sailbaba for unlawful activities;
- Violate another person’s legal rights; or
- Interfere with the operation or security of the Website.
Sailbaba may suspend or terminate access where prohibited activity is suspected or identified.
21. THIRD-PARTY SERVICES AND LINKS
Sailbaba may contain links to third-party websites, services, brokers, manufacturers, payment providers, communication tools, or other external resources.
Sailbaba does not control and is not responsible for third-party websites or services.
Your use of third-party services may be governed by their own terms and privacy policies.
22. WEBSITE AVAILABILITY
Sailbaba aims to maintain a reliable and secure Website but does not guarantee uninterrupted or error-free availability.
The Website may occasionally be unavailable because of:
- Maintenance;
- Technical problems;
- Server issues;
- Security incidents;
- Software updates;
- Internet or telecommunications failures;
- Third-party service interruptions; or
- Circumstances beyond Sailbaba’s reasonable control.
Sailbaba shall not be responsible for losses arising solely from temporary Website unavailability to the extent permitted by applicable law.

Sailbaba will take reasonable measures to protect information that is submitted specifically for verification or other confidential purposes.
However, information intentionally submitted for public display as part of a Listing should not be considered confidential.
Listing Customers should clearly identify information that is being provided solely for verification or confidential purposes.
26. INDEMNIFICATION
To the extent permitted by applicable law, each Listing Customer agrees to indemnify and hold harmless Sailbaba and its owners, directors, officers, employees, contractors, and service providers from claims, losses, liabilities, damages, costs, and expenses arising from:
- The Listing Customer’s breach of these Terms;
- False or misleading Listing Content;
- Lack of ownership or authorization;
- Infringement of third-party intellectual property rights;
- Violation of applicable law;
- Disputes between Buyers and Sellers;
- The yacht or its condition;
- The Listing Customer’s conduct; or
- A transaction entered into between the Listing Customer and a Buyer.
27. LIMITATION OF LIABILITY
To the maximum extent permitted by applicable law, Sailbaba shall not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or related to:
- Use of the Website;
- Inability to use the Website;
- Yacht Listings;
- Information contained in Listings;
- Communications between Buyers and Sellers;
- Failed or incomplete transactions;
- Fraud or misconduct by another user;
- Yacht condition or performance;
- Ownership or title disputes;
- Loss of business or profits; or
- Reliance upon information published on the Website.
Where liability cannot legally be excluded, Sailbaba’s liability shall be limited to the maximum extent permitted by applicable law.
Nothing in these Terms is intended to exclude or limit liability that cannot legally be excluded or limited.
28. NO PROFESSIONAL ADVICE
Information provided on Sailbaba is for general informational and marketplace purposes.
Sailbaba does not provide legal, financial, tax, insurance, engineering, marine surveying, valuation, brokerage, or other professional advice unless expressly stated otherwise in writing.
Users should obtain appropriate independent professional advice before making significant decisions concerning a yacht or transaction.
29. ACCOUNT SUSPENSION AND TERMINATION
Sailbaba may suspend, restrict, or terminate a user’s access to the Website or Listing services if the user:
- Breaches these Terms;
- Provides fraudulent or misleading information;
- Submits an unauthorized Listing;
- Engages in unlawful conduct;
- Misuses the Website;
- Attempts to compromise Website security; or
- Engages in conduct that may harm Sailbaba, other users, or the integrity of the marketplace.
Sailbaba may also remove a Listing where continued publication is reasonably considered inappropriate or commercially or legally risky.
30. CHANGES TO LISTINGS
Sailbaba may make reasonable formatting, technical, editorial, or presentation changes to Listing Content to ensure compatibility with the Website.
Sailbaba may request corrections or updates from the Listing Customer where information appears incomplete, inaccurate, outdated, or misleading.
Material changes to a Listing should be communicated to Sailbaba promptly.
31. CHANGES TO THESE TERMS
Sailbaba may update these Terms from time to time.
Updated Terms will be published on the Website with a revised “Last Updated” date.
Your continued use of Sailbaba after updated Terms are published constitutes acceptance of the revised Terms, to the extent permitted by applicable law.
32. FORCE MAJEURE
Sailbaba shall not be responsible for delays or failures caused by circumstances beyond its reasonable control, including natural disasters, war, civil unrest, government action, cyber incidents, telecommunications failures, internet outages, pandemics, strikes, infrastructure failures, or failures of third-party service providers.
33. SEVERABILITY
If any provision of these Terms is determined to be invalid, unlawful, or unenforceable, the remaining provisions shall continue in full force and effect to the extent permitted by law.
34. NO WAIVER

These Terms, together with the Privacy Policy and any additional terms specifically applicable to a purchased service, constitute the agreement between you and Sailbaba concerning your use of the Website and its services, unless otherwise expressly agreed in writing.
36. GOVERNING LAW AND JURISDICTION

38. IMPORTANT NOTICE TO LISTING CUSTOMERS
By purchasing Listing Space or submitting a yacht to Sailbaba, you acknowledge and agree that:
- You are purchasing a listing/promotion service, not a yacht;
- You have the authority to advertise the yacht;
- The information you provide must be accurate and lawful;
- Sailbaba may request documentation to verify the yacht and your authority to represent it;
- Private verification information is not intended for public display;
- Public Listing Content may be viewed by potential Buyers and other Website visitors;
- Sailbaba does not guarantee the condition, title, value, seaworthiness, availability, or sale of any yacht;
- Sailbaba is generally not a party to transactions between Buyers and Sellers;
- You are responsible for conducting your own due diligence before entering into any transaction; and
- Your use of Sailbaba is subject to these Terms & Conditions and the Sailbaba Privacy Policy.
